1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and EchoFlow ("Company," "we," "us," or "our"). By accessing, browsing, or using the EchoFlow service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

EchoFlow is a video transformation and social media publishing platform that allows users to:

• Upload and process video content
• Transform videos for different social media formats (YouTube Shorts, Instagram Reels, TikTok videos, X/Twitter videos)
• Connect social media accounts through OAuth authentication
• Automatically publish transformed content to connected platforms
• Manage video publishing workflows through our API and web interface

3. User Eligibility

To use EchoFlow, you must:

• Be at least 18 years old or have parental consent
• Have the legal capacity to enter into binding agreements
• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials
• Comply with all applicable laws and regulations

4. Account Registration and Security

4.1 Account Creation

You may create an account using email registration or by connecting through supported OAuth providers (Google, Microsoft). You are responsible for maintaining accurate account information.

4.2 Account Security

You agree to:

• Maintain the confidentiality of your login credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities that occur under your account
• Use strong passwords and enable security features when available

5. Social Media Platform Integration

5.1 OAuth Connections

EchoFlow integrates with third-party social media platforms (TikTok, YouTube, Instagram, X/Twitter) through their official APIs. By connecting these accounts, you authorize us to:

• Access your profile information as permitted by the platform
• Upload and publish content to your connected accounts
• Manage video metadata and settings according to your instructions

5.2 Platform Terms Compliance

You acknowledge that your use of connected social media platforms is subject to their respective terms of service, community guidelines, and content policies. You agree to comply with all such terms and understand that violations may result in account restrictions on those platforms.

6. User Content and Intellectual Property

6.1 Your Content

You retain ownership of all content you upload to EchoFlow. By using our service, you grant us a limited, non-exclusive license to:

• Process, transform, and optimize your videos
• Store content temporarily during processing
• Publish content to your connected social media accounts as instructed
• Use anonymized usage data to improve our service

6.2 Content Responsibilities

You represent and warrant that:

• You own or have necessary rights to all uploaded content
• Your content does not infringe on third-party intellectual property
• Your content complies with applicable laws and platform policies
• You will not upload malicious, harmful, or illegal content

7. Prohibited Uses

You agree not to use EchoFlow for any of the following prohibited activities:

• Uploading content that infringes copyright, trademark, or other intellectual property rights
• Distributing malware, viruses, or other harmful software
• Attempting to gain unauthorized access to our systems or other users' accounts
• Using the service for spam, fraud, or other deceptive practices
• Violating any applicable laws, regulations, or third-party rights
• Reverse engineering, decompiling, or attempting to extract our source code
• Using the service to compete directly with EchoFlow

8. Service Availability and Limitations

8.1 Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We may temporarily suspend service for maintenance, updates, or technical issues.

8.2 Usage Limits

We may impose reasonable limits on:

• File size and duration of uploaded videos
• Number of processing requests per time period
• Total storage space and bandwidth usage
• API call frequency and concurrent operations

9. Payment and Billing

9.1 Pricing

EchoFlow offers both free and paid service tiers. Current pricing information is available on our website and subject to change with reasonable notice.

9.2 Payment Terms

• Paid services are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by applicable law
• You are responsible for all taxes associated with your use of the service
• We may suspend service for non-payment after reasonable notice

10. Privacy and Data Protection

11. Disclaimers and Limitations of Liability

11.1 Service Disclaimer

EchoFlow is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.2 AI and Automated Processing Disclaimer

EchoFlow utilizes artificial intelligence (AI), machine learning, and automated processing technologies to transform, analyze, and optimize video content. You acknowledge and agree that:

• AI-generated outputs may contain errors, inaccuracies, or unexpected results
• Automated content transformations may not always meet your expectations or requirements
• AI systems may occasionally produce content that is inappropriate, misleading, or does not accurately represent the original material
• We do not guarantee the accuracy, quality, or suitability of any AI-generated or AI-processed content
• You are solely responsible for reviewing and approving all content before publishing to any platform
• We are not liable for any consequences arising from the use of AI-generated or AI-processed content

11.3 Technical Limitations and Service Interruptions

You acknowledge and agree that:

• Technical failures, bugs, errors, or service interruptions may occur at any time
• Video processing may fail, produce corrupted outputs, or result in data loss
• Third-party platform APIs (YouTube, TikTok, Instagram, X/Twitter) may change, become unavailable, or reject content without notice
• Publishing to connected platforms may fail due to platform restrictions, rate limits, or policy violations
• We are not responsible for any platform account suspensions, restrictions, or penalties resulting from content published through our service
• Scheduled posts may not be published at the exact requested time due to system load or technical issues
• We do not guarantee successful delivery of content to any third-party platform

11.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ECHOFLOW AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, business opportunities, or goodwill
• Cost of substitute services or procurement
• Any damages arising from AI-generated content, automated processing errors, or algorithmic decisions
• Any damages arising from service interruptions, technical failures, or data loss
• Any damages arising from third-party platform actions, policy changes, or account restrictions
• Any damages arising from unauthorized access to your account or content
• Any damages exceeding the total amount paid by you to EchoFlow in the twelve (12) months preceding the claim

These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if EchoFlow has been advised of the possibility of such damages.

11.5 No Professional Advice

EchoFlow does not provide legal, financial, marketing, or professional advice. Any suggestions, recommendations, or automated decisions made by our AI systems are for informational purposes only and should not be relied upon as professional guidance.

12. Indemnification

You agree to indemnify, defend, and hold harmless EchoFlow and its affiliates, officers, directors, employees, agents, partners, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to:

• Your use of the service or violation of these Terms
• Your content or any copyright, trademark, or other intellectual property infringement
• Your violation of any third-party rights or applicable laws
• Content you publish through our service, including AI-processed or transformed content
• Any claim that your content caused damage to a third party
• Your interactions with third-party platforms through our service
• Any misrepresentation made by you
• Your failure to comply with applicable laws, regulations, or platform policies
• Any third-party claims arising from content published to your connected social media accounts

13. Termination

13.1 Termination by You

You may terminate your account at any time by deleting your account through the service interface or contacting us.

13.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms of Service
• Your account is used for fraudulent or illegal activities
• We are required to do so by law or legal process
• We discontinue the service (with reasonable notice)

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated terms on our website and updating the "Last Updated" date. Your continued use of the service after changes become effective constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of EchoFlow shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, except for claims that may be brought in small claims court.

You agree that any arbitration shall be conducted on an individual basis and not as a class action or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against EchoFlow.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
